1. Who we are
This website is operated by Andy Resort Inc. (“we,” “us,” or “our”), located at 18780 Lenaire Drive, Miami, FL 33157. This Privacy Policy explains what personal information we collect through this website — including our booking inquiry form — and how we use, share, and protect it. By using this website, you acknowledge the practices described in this policy.
2. Information we collect
Information you provide through booking inquiries
- Contact information: first and last name, email address, and phone number
- Stay details: preferred accommodation, preferred check-in and check-out dates, and number of guests
- Your message: any additional questions or requests you choose to include
- Communication preference: whether you chose to opt in to text messages (SMS)
Please do not include sensitive information — such as passport, driver’s license, Social Security, or payment card numbers — in the booking inquiry form. We do not request that information through this website.
Information collected automatically when you submit the form
To keep an accurate record of your inquiry and of any text message consent you give, we also record:
- The date and time of your submission
- The web page address from which the form was submitted
- The exact wording and version of the SMS consent disclosure displayed to you
- Your device’s IP address
- Basic browser information (the “user agent” string your browser sends)
Information from communications
If you email, call, or text us, we keep a record of that communication, including any opt-out or help requests.
3. How we use information
We use the information described above to:
- Review and respond to your booking inquiry
- Confirm availability for your dates and coordinate reservation details with you
- Send booking-related text messages, only if you opted in
- Keep records of inquiries and of SMS consent and opt-out requests
- Protect our website and customers against fraud, spam, and misuse
- Comply with legal obligations and enforce our Terms of Service
We do not use information from booking inquiries for third-party advertising, and we do not use it to make automated decisions that have legal or similarly significant effects on you.
4. Customer communication practices
We respond to booking inquiries using the email address or phone number you provide. Our communications relate to your inquiry — for example, availability, questions about your requirements, and booking details.
We send text messages only to customers who voluntarily check the optional SMS consent box on our booking inquiry form. Checking the box is not required to submit an inquiry or to make a reservation. SMS consent collected on this website is used only for the booking-related messages described in our SMS Terms & Conditions and is not used for promotional or advertising text messages.
5. SMS consent and data sharing
SMS SHARING: No mobile information or SMS opt-in consent will be shared with third parties or affiliates for their own marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with any third parties, except authorized messaging service providers that help us deliver text messages. Those providers may process your phone number and message content solely to provide the requested messaging services to us, subject to applicable legal and carrier requirements, and are not permitted to use your information for their own purposes.
You can opt out of text messages at any time by replying STOP to any message from us. Reply HELP for assistance. Message frequency varies based on booking or reservation status. Message and data rates may apply. We keep a record of your consent and of any opt-out request so that we can honor your choice.
6. How we share information
We share personal information only as described below.
Third-party service providers
We use service providers that help us operate this website and our business, and they receive only the information needed to perform services for us:
- Website hosting provider — stores this website and its database, including booking inquiries.
- Email service — delivers inquiry notifications to our team and our replies to you.
- Messaging service provider — if we send text messages to customers who opted in, delivers those messages.
- Google Fonts — delivers the typefaces used on this website (see Section 8).
Legal and safety reasons
We may disclose information if required by law, subpoena, or other legal process; to respond to lawful requests from public authorities; or to protect the rights, safety, and property of our customers, our business, or others.
Business transfers
If our business is sold, merged, or reorganized, customer information may be transferred as part of that transaction, subject to this Privacy Policy.
Every disclosure described in this section remains subject to the SMS sharing commitment in Section 5.
7. No sale of personal information
We do not sell, rent, or trade your personal information, and we do not share it with third parties for their own marketing purposes.
8. Cookies, fonts, and Do Not Track
This website uses a single strictly necessary session cookie on the booking inquiry form to protect it against fraudulent submissions. It is deleted when you close your browser. We do not use advertising cookies, analytics, or tracking tools, and we do not allow third parties to track your activity on this website over time.
Our pages load typefaces from Google Fonts. When your browser requests these fonts, Google receives your IP address and basic browser information as part of delivering them, under Google’s own privacy policy.
Do Not Track: Because we do not track visitors across websites, we do not change our practices in response to “Do Not Track” browser signals.
9. Data security
We use reasonable administrative, technical, and physical safeguards to protect the information we collect. This website is intended to be served over an encrypted (HTTPS) connection, inquiry records are stored in a database that is not publicly accessible, and access to inquiry records is restricted to authorized staff with password-protected accounts. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
If a security incident affects your personal information, we will notify you and the appropriate authorities as required by applicable law, including the Florida Information Protection Act (Section 501.171, Florida Statutes).
10. Data retention
We keep booking inquiry information for as long as needed to respond to your inquiry and coordinate any resulting reservation and stay. We keep records of SMS consent and opt-out requests for as long as necessary to document your communication preferences and meet our legal obligations. We retain these records for up to five (5) years after your most recent inquiry or communication with us, unless a longer period is required by law. When information is no longer needed, we securely delete it or make it anonymous.
11. Your choices and rights
- Text messages: Reply STOP to any of our text messages to opt out at any time, or contact us using the details below.
- Review and correction: You may ask to review the personal information we hold about you and to correct anything that is inaccurate.
- Deletion: You may ask us to delete your personal information. We may keep limited records where needed to honor your request (for example, a record that you opted out of text messages) or to meet legal obligations.
- Email: Let us know if you’d prefer that we not contact you by email.
To make a request, contact us using the information in Section 15. We may need to confirm your identity before acting on a request, and we will respond within the time required by applicable law. Depending on where you live, you may have additional privacy rights under the laws of your state; we will honor those rights as required. We will not discriminate against you for exercising your privacy rights.
12. Children’s privacy
This website and our booking services are intended for adults. We do not knowingly collect personal information from children under 13, and booking inquiries should be submitted only by people 18 or older. If you believe a child has submitted information to us, please contact us and we will delete it.
13. Links to other websites
This website may link to other websites that we do not operate. We are not responsible for the privacy practices of those websites, and we encourage you to read their privacy policies.
14. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will post the updated policy on this page and update the “Last updated” date above. If we make material changes to how we use or share personal information, we will provide notice on this website before the changes take effect. We will not use SMS consent for new purposes without obtaining new consent.
